Terms of Use.

The rules for using this website. Client engagements are covered by separate written agreements.

1. Agreement to these terms

These Website Terms of Use (“Terms”) govern your use of www.omnibotcloud.com (the “Site”), operated by Omnibot Cloud LLC (“Omnibot Cloud”, “we”, “us”). By using the Site you agree to these Terms. If you don’t agree, please don’t use the Site.

If you use the Site on behalf of an organization, you confirm that you are authorized to accept these Terms for it.

2. The Site and our services

The Site gives general information about Omnibot Cloud and a way to contact us. It does not itself provide any service. Any consulting, engineering or other services we provide are governed by a separate written agreement signed by both parties. If that agreement conflicts with these Terms, the agreement wins. Any future OmniBot Cloud online platform will have its own Platform Terms of Service.

Sending an inquiry does not create a client relationship, a contract, or any duty of confidentiality. Please don’t send confidential or proprietary information through the contact form; we can arrange a non-disclosure agreement before detailed discussions.

3. Product information and pre-release features

Descriptions of our capabilities, products and roadmap are for general information only. They may change at any time without notice and are not a commitment to deliver any feature, product or result. Some products may be offered as early-access or beta versions; those are provided under separate terms and may be incomplete, change or be withdrawn.

4. Acceptable use

You agree not to:

  • Use the Site in any way that breaks applicable law or regulation
  • Try to gain unauthorized access to the Site, its servers, or any connected system or network
  • Interfere with or disrupt the Site, including through denial-of-service attacks, malware, or excessive automated requests
  • Scrape, harvest or collect data from the Site by automated means, except standard search-engine indexing that follows our robots.txt
  • Send spam, unsolicited advertising, or false or misleading information through the contact form
  • Impersonate any person or organization, or misrepresent your affiliation with one

5. Intellectual property

The Site and its content — including text, graphics, logos, design and code — are owned by Omnibot Cloud or its licensors and protected by intellectual property laws. “Omnibot Cloud” and our logo are our trademarks. We give you a limited, non-exclusive, non-transferable, revocable license to view the Site for your own informational purposes. You may not copy, modify, distribute, sell or create derivative works from any part of the Site without our prior written permission.

6. Your submissions

You keep ownership of anything you send us. You give us permission to use it to respond to you and to evaluate a possible engagement. If you send unsolicited ideas or suggestions, we may use them without any obligation to you.

7. Third-party links and services

The Site may link to or rely on third-party websites and services. We don’t control them and aren’t responsible for their content, policies or practices. Your use of them is at your own risk and subject to their terms.

8. Disclaimers

The Site and its content are provided “as is” and “as available”. Content is for general information only and is not professional, engineering, safety or legal advice. Illustrative material on the Site (for example, sample system output) shows concepts and is not a description of any specific system’s performance.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We don’t warrant that the Site will be uninterrupted, error-free or free of harmful components.

9. Limitation of liability

To the fullest extent permitted by law, Omnibot Cloud and its members, officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or goodwill, arising from or related to your use of the Site. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars (US$100).

Some jurisdictions don’t allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

10. Indemnity

You agree to indemnify and hold harmless Omnibot Cloud from claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Site.

11. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in that State, and you consent to their jurisdiction. This does not take away any mandatory consumer protections you have under the laws of your country of residence.

12. Changes and termination

We may change these Terms or the Site at any time. Changes take effect when posted, and the “Last updated” date above will change. Continuing to use the Site after a change means you accept it. We may suspend or restrict access to the Site for anyone who breaks these Terms.

13. General

If any provision of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with our Privacy Policy and Cookie Policy, are the entire agreement between you and us about the Site.

14. Contact us

Questions about these Terms, and legal notices to Omnibot Cloud, should be sent to support@omnibotcloud.com.
